1.1 This FacetScore Terms of Service ("Terms") is entered into between Arkilon Ltd ("we," "us," "our"), a company registered in Scotland with its principal place of business at 272 Bath Street, Glasgow, G2 4JR, and you, our customer or potential customer ("you," "your").
1.2 By accessing or using the FacetScore service ("Service"), you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using our Service.
1.3 These Terms should be read in conjunction with the Data Collection Agreement, which forms an integral part of your agreement with us.
2.1 FacetScore is a SaaS product designed to provide AI-powered analysis and rating systems for business performance.
2.2 The Service is offered by Arkilon Ltd, registered in Scotland as SC730513, with a registered office at 272 Bath Street, Glasgow, G2 4JR.
3.1 To use FacetScore, you must create an account by providing accurate and complete information.
3.2 You are responsible for maintaining the confidentiality of your account credentials.
3.3 You agree not to share your account or allow others to access it using your credentials.
4.1 FacetScore operates on a subscription basis. We offer various plans, each with specific features and limits.
4.2 Fees for the Service will be charged in GBP and are exclusive of VAT/GST, which will be applied based on your location.

5.1 You agree to use FacetScore only for lawful purposes and in accordance with these Terms.
5.2 You are solely responsible for any content you generate, upload, or otherwise transmit using our Service.

5.4 We reserve the right to limit or restrict your access to the Service if our monitoring detects unusually high levels of usage or if your use of an Unlimited plan unfairly impacts the quality of service for other customers. Before taking any such action, we will make reasonable efforts to contact you to address the issue.

7.1 All intellectual property rights in FacetScore and related services, including but not limited to software, content, and trademarks, belong to Arkilon Ltd or its licensors.
7.2 You are granted a limited, non-exclusive license to use the Service for its intended purpose.
7.3 You may not reproduce, distribute, modify, or create derivative works from any part of the Service without express permission.
8.1 The collection and processing of data through the FacetScore service are governed by the Data Collection Agreement.
8.2 By using the Service, you agree to the terms outlined in the Data Collection Agreement.
8.3 This agreement covers the manner in which we collect, store, and use your data, including any third-party services involved in data processing.
9.1 FacetScore is committed to the ethical use of data, particularly in relation to artificial intelligence (AI) and machine learning technologies. Our practices regarding AI training are guided by the following principles:
Protection of Raw Data: We do not use raw customer data for training our AI models. Your individual data remains confidential and is used solely for providing the FacetScore service to you.
Use of Aggregated and Anonymized Data: Any use of data for improving our AI systems is strictly limited to aggregated, anonymized insights that cannot be traced back to individual customers or their data sources.
Transparency: We believe in full transparency regarding our data processing methods, including those related to AI training.

11.1 These Terms may be provided in languages other than English for your convenience.
11.2 The English version of these Terms is the only legally enforceable version.
11.3 We do not guarantee that the translated versions will always be up to date or accurate.
11.4 In the event of any inconsistency, the English version shall prevail.
12.1 To the extent permitted by law, Arkilon Ltd shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of FacetScore.
12.2 This includes, but is not limited to, loss of profits, data, or business opportunities.
13.1 We reserve the right to modify these Terms at any time.
13.2 We will notify you of any significant changes by posting the updated Terms on our website and sending an email to registered users.
13.3 Continued use of the Service after any changes indicates your acceptance of the new Terms.
14.1 These Terms are governed by the laws of Scotland.
14.2 For customers who sign up for the Service in Japan, Japanese law will apply.
14.3 Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Scotland or Japan, depending on your location.
